On Tuesday, November 22nd a Texas federal court will decide whether to issue an injunction which would put on hold the Department of Labor’s new FLSA “White Collar” rule that increases the minimum salary threshold to $47,476 on December 1, 2016 for exempt workers.
The presiding judge stated that if an injunction is not granted, he will rule on the pending motion for summary judgment on November 28th, just three days before the law is to become effective. If summary judgment is granted, the case will be disposed of without a trial and there will be no increased salary mandates.
